1. Acceptance of Terms

By accessing or using KidsCheck ("the Service"), operated by KidsCheck Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

KidsCheck is a cloud-based children's ministry check-in platform designed for churches and religious organizations. The Service provides digital check-in/check-out management, parent communication, volunteer coordination, and related administrative tools.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Payment

  • Free Plan: Limited to 25 children, 1 classroom, and 1 admin user. No payment required.
  • Pro Plan ($49/month): Up to 200 children, 10 classrooms, 5 team members, and advanced features.
  • Enterprise Plan ($149/month): Unlimited usage with custom domains, API access, and priority support.

Paid subscriptions are billed monthly or annually. You authorize us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the Service to collect personal information about children without proper parental consent
  • Share or sell data obtained through the Service to third parties

6. Data Ownership

You retain ownership of all data you upload to the Service, including child records, parent information, and organizational data. We do not claim ownership of your data. Upon account termination, you may request an export of your data within 30 days.

7. Children's Data Protection

We comply with the Children's Online Privacy Protection Act (COPPA) and applicable data protection laws. See our Privacy Policy for details on how we handle children's information. You, as the church or organization, are responsible for obtaining proper parental consent before entering children's data into the system.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for service interruptions caused by circumstances beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, KidsCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
